By using Performance Hub, you acknowledge and agree to every provision in this Disclaimer.
1. What Performance Hub Is NOT
1.1 Not Medical Advice
Performance Hub DOES NOT provide:
- Medical diagnosis, treatment, or advice
- Professional medical guidance or recommendations
- Medical prognosis or consultation
- Healthcare or telemedicine services
Our coaches and app:
- Are NOT healthcare providers or doctors
- Are NOT licensed medical professionals
- Are NOT qualified to provide medical advice
- Do NOT have medical authority over you
- Cannot diagnose or treat medical conditions
If you need medical advice:
- Consult your physician
- Consult a licensed healthcare provider
- Call 911 for emergencies
- Do not rely on Performance Hub
1.2 Not a Healthcare Provider
Performance Hub is NOT:
- A licensed healthcare organization
- HIPAA-covered entity (though we comply with HIPAA principles)
- FDA-regulated or FDA-approved
- A medical device or diagnostic tool
- A therapy, psychiatric, or rehabilitation service
1.3 Fitness and Wellness Tool
Performance Hub IS:
- A fitness and training tool
- A wellness app for tracking and logging
- For healthy individuals
- For informational purposes
- For training optimization and performance tracking
2. Exercise Carries Risk of Serious Injury and Death
2.1 Inherent Risks of Exercise
Physical exercise carries risks including:
- Muscle strains and ligament tears
- Fractures and broken bones
- Dislocations and joint injuries
- Spinal injuries and paralysis
- Head trauma and concussions
- Internal bleeding
- Cardiac arrhythmia
- Myocardial infarction (heart attack)
- Sudden cardiac death
- Stroke and aneurysm
- Rhabdomyolysis
- Heat exhaustion and heat stroke
- Dehydration and electrolyte imbalance
- Seizures and loss of consciousness
- Permanent disability
- Death
2.2 Risk of Sudden Cardiac Death
Sudden cardiac death can occur:
- In young, healthy individuals
- Without warning or symptoms
- During or after exercise
- Even in athletes with prior cardiac clearance
You may have undetected cardiac conditions including arrhythmia, enlarged heart, coronary artery disease, myocarditis, or other conditions.
2.3 You Assume All Risks
By using Performance Hub and exercising, you:
- Assume ALL risks of injury
- Assume ALL risks of death
- Waive claims against Company
- Accept personal responsibility
- Understand risks cannot be eliminated
- Accept these risks VOLUNTARILY
3. Required Medical Clearance
3.1 Medical Clearance Required
BEFORE using Performance Hub, you MUST obtain physician clearance if you have ANY of:
- Age 45+ (men) or 55+ (women)
- Family history of cardiac disease or sudden death
- Personal history of cardiac disease
- High blood pressure or cholesterol
- Diabetes or prediabetes
- History of smoking
- Obesity (BMI > 30)
- Sedentary lifestyle
- Any cardiac symptoms or chest pain
- Any medical condition whatsoever
- Any surgery or medical procedure
- Any medication use
- Pregnancy
- History of injury or pain
- Mental health conditions
- Any doubt or concern whatsoever
3.2 If You Have Any Medical Condition
Do NOT use Performance Hub or exercise without:
- Consulting your physician
- Getting medical clearance
- Getting specific exercise and intensity approval
- Getting ongoing medical monitoring
- Your doctor's explicit written approval
Not consulting your doctor is extremely dangerous and potentially life-threatening. We are NOT liable.
4. Specific Health Conditions
Consult your physician BEFORE exercise if you have:
4.1 Cardiovascular Conditions
- Heart disease, coronary artery disease, prior heart attack
- Heart failure, cardiac arrhythmia, atrial fibrillation
- Cardiomyopathy, myocarditis, pericarditis
- High blood pressure (controlled or uncontrolled)
- History of stroke or TIA
- Peripheral artery disease, aortic aneurysm
- Cardiac implants (pacemaker, defibrillator)
4.2 Pulmonary Conditions
- Asthma, COPD, emphysema, chronic bronchitis
- Pulmonary fibrosis, cystic fibrosis
- Pulmonary hypertension, pneumothorax
- Severe sleep apnea
4.3 Neurological Conditions
- Epilepsy or seizure disorder
- Parkinson's disease, multiple sclerosis, ALS
- Spinal cord injury, traumatic brain injury
- Vertigo, balance disorders, syncope
4.4 Metabolic Conditions
- Diabetes (Type 1 or Type 2)
- Severe hypoglycemia history
- Thyroid disease (uncontrolled)
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFORMANCE HUB AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DISABILITY, OR DEATH ARISING FROM YOUR USE OF THE SERVICE OR ANY EXERCISE ACTIVITIES.
You expressly waive and release Performance Hub from any and all claims, demands, and causes of action related to physical injury, illness, or death.
